Open Auction

Open Auction is a type of chit scheme that can be conducted by a registered chit company. An auction is held every month.
For example, in 20-month, 30-month, and 40-month groups, an auction is conducted every month. All eligible customers participate in the auction. The customer who offers the highest bid amount in the auction is awarded the prized money.

After the auction is completed, each member can know their respective due amount and the dividend amount they are entitled to receive.
This process continues every month, from the first month until the completion of the 20-month, 30-month, or 40-month chit group.

Token System

The Token System can be used during the auction process, including from the first month through the tenth month.
For example, if more than one person bids the maximum auction amount in the same month, and the maximum bid is 30%, there may be one to ten members who offer the same 30% bid amount.
In such a situation, the Token System is used. The names of all the members who have offered the highest bid amount are entered into a draw. The winner is selected through a random draw.
The member whose name is selected first in the draw is considered the winner of that month's auction, and the prized money is awarded to that member for that month.

Under this system, members who win the auction from the 1st to the 10th month will receive the amount at ₹1.5 % interest.
For auctions conducted from the 11th to the 15th month, the members will receive the amount at ₹1 % interest.
For auctions conducted after the 15th month and up to the 20th month, the members will receive the applicable amount as profit/benefit.

The chit fund system conducted by chit fund companies is a method in which both people who have money and those who need money can participate.
In this system, members who have available funds contribute their money through the chit fund company, which facilitates the scheme and provides the funds to members who need them.

It is a simple and convenient financial system. Members who need money can receive the chit amount as a form of financial assistance, subject to the terms and conditions of the chit scheme.
In some cases, people living in the same village, town, locality, or even on the same street participate in the same chit group. Since the members may already know each other, the company may have simpler documentation or security requirements, depending on its policies and applicable regulations.
Thus, the chit fund system can provide members with a structured way to save money and access funds when they need them.

Registered Chit Group minutes

A registered chit group is one where all the details of the auction conducted every month are properly recorded in the minutes.
The minutes include details such as the due amount, dividend amount, prized money, and other relevant information related to the monthly auction.
These minutes and relevant records are submitted to and registered with the Chit Registrar’s Office as required under the applicable rules and regulations.
The details of each monthly auction are maintained as official records with the Registrar’s Office.

Registered Chit Groups legal notice or complaint

For groups registered with the Registrar’s Office, if any issues arise with the chit company, the members’ money may be returned or protected according to the applicable laws, rules, and procedures.
Members who win the prized money may be required to provide security or surety, particularly in a registered chit group, as per the company’s terms and applicable regulations.

If a prized member fails to pay the required monthly installments until the end of the chit period, the company may take appropriate legal action to recover the outstanding amount, in accordance with applicable laws and procedures.
Legal notices or complaints may be issued to the concerned member through the company’s legal representatives or advocates.
Any applicable advocate fees, legal expenses, documentation charges, and other recovery-related costs may be charged to the concerned member, subject to the terms of the chit agreement and applicable laws and regulations.

The company may issue the First Legal Notice, Second Legal Notice, and Third Legal Notice sequentially to the concerned member.
Information regarding each notice may be communicated to the member through SMS, WhatsApp, or a written letter, depending on the company’s procedures.

Each legal notice or complaint may be followed by further legal proceedings, as applicable.
Finally, a member who has received the prized money must continue to pay the outstanding monthly dues until the completion of the chit period. Any applicable late fee or penalty amount must also be paid along with the monthly due, in accordance with the chit agreement and applicable rules.

If a member who has received the prized money fails to pay the required monthly dues and applicable penalties, legal action may be initiated against the member in accordance with the chit agreement and applicable laws.
If security or surety has been provided, the company may seek recovery against that security or surety through the appropriate legal or court process. Any enforcement or attachment would be carried out only through the procedure permitted by the court and applicable law.
